The era of disputes between tenants and landlords going unresolved is over. Since the inception of Limpopo Rental Housing Tribunal, stability has been brought in the housing market. The Rental Housing Act guarantees the right of "any tenant or landlord or group of tenants or interest group" to lodge a complaint with the Tribunal concerning an unfair practice. The act requires government to promote a stable and growing market that progressively meets the demand for affordable rental housing among persons historically disadvantaged by unfair discrimination and poor persons.
The tribunal's functions amongst others are to harmonize relations and provide free services in resolving disputes and unfair practices between the tenants and landlords; to inform and educate the landlords and tenants about their rights and obligations in terms of the Rental Housing Act.
A ruling of the Tribunal carries the same authority as that of a Magistrate court. The Tribunal deals with disputes in the rental housing sector, mediating between parties through conducting hearings. For example, a complaint was lodged on the 07th of September 2009 for non payment of rent. Mediation was conducted three (3) days later (on 10th September 2009) and was resolved. The respondent agreed to pay arrears amounting to R8 676.78 plus interest. The money has since been paid by the complainant to the respondent.
Any tenant or landlord or a group of tenants or landlords or an interest group who resides in Limpopo Province, may in the prescribed manner lodge a complaint with the Tribunal concerning an unfair practice.
Issues that are handled by the tribunal (amongst others) include rentals, leases, threats/ illegal evictions, deposits, maintenance, damage to property, Demolitions and conversions, forced entry and obstruction of entry, House rules, intimidation, issuing of receipts, municipal services, Nuisance ,overcrowding and health matters, tenant activities, reconstruction and refurbishment.
Complaints must be lodged on the Complaints Form obtainable from the Offices of the Tribunal or Rental Housing Information Office.
